These Terms & Conditions (the “Terms”) govern your access to and use of the facilities, equipment, services, events, memberships, rentals, and website of Rabbit Hole Studios (“Rabbit Hole Studios,” “RHS,” “we,” “us,” or “our”), located at 1001 Winterville Rd, Athens, GA 30605. By becoming a member, booking a space or session, renting equipment, attending an event, or otherwise using our services, you (“you,” “member,” or “guest”) agree to be bound by these Terms. If you do not agree, please do not use our facilities or services.
1. Eligibility & Membership
You must be at least 18 years old to enter into a membership or booking agreement. Minors may use the facilities only under the direct supervision of a parent, legal guardian, or an authorized adult who accepts responsibility for them. Memberships are personal to you and may not be shared, transferred, or assigned without our written consent. You are responsible for keeping your account and contact information accurate and current.
2. Bookings, Payments, Cancellations & Refunds
- Bookings for coworking, offices, the recording and rehearsal studios, the event venue, and equipment rentals may be made through our website, our scheduling tools, or in person, and are confirmed only once payment or any required deposit is received.
- Fees, deposits, and applicable taxes are due at the time of booking unless otherwise agreed in writing. Recurring membership fees are billed in advance on a per-period basis.
- Cancellations made at least 48 hours before a booked session or event may be eligible for a credit or refund of fees paid, less any non-refundable deposit. Cancellations within 48 hours, and no-shows, may be charged in full.
- We may reschedule or cancel a booking due to circumstances beyond our reasonable control (including equipment failure, facility issues, or events of force majeure); in that case we will offer a credit or refund for the affected booking as your sole remedy.
3. Facility & Equipment Use
You agree to use the premises, furnishings, instruments, tools, audio/visual gear, e-bikes, and all other equipment safely, responsibly, and only for their intended purposes, and to follow all posted rules, signage, and staff instructions. You agree not to exceed the rated capacity of any room or piece of equipment, not to remove equipment from the premises unless expressly rented for off-site use, and to report any damage, malfunction, or unsafe condition to staff immediately. You are responsible for the conduct of any guests you bring on-site.
4. Assumption of Risk, Release & Liability Waiver
Please read this section carefully — it affects your legal rights.
You understand and acknowledge that use of a creative studio, maker space, event venue, and shared work environment — including the use of musical instruments, power and hand tools, audio and electrical equipment, e-bikes and other recreational equipment, and participation in events, classes, and gatherings — involves inherent and other risks of injury, illness, property damage, or loss. These risks may result from your own actions or inactions, the actions of others, the condition of the equipment or premises, or other causes.
Voluntary Participation & Assumption of Risk. You voluntarily choose to use the facilities, equipment, and services and to participate in any activities, and you knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of others.
Release & Waiver. To the fullest extent permitted by Georgia law, you, on behalf of yourself and your heirs, assigns, and personal representatives, release, waive, and agree not to sue Rabbit Hole Studios and its owners, officers, members, employees, contractors, and volunteers (the “Released Parties”) from and against any and all claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by you or any property belonging to you while on the premises, using the equipment or services, or participating in any activity, except to the extent caused by the Released Parties’ gross negligence or willful misconduct.
Indemnification. You agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) brought by you or any third party arising from your use of the facilities, equipment, or services, your breach of these Terms, or the conduct of your guests.
This waiver is intended to be as broad and inclusive as permitted by the law of the State of Georgia. If any portion is held invalid, the remainder shall continue in full legal force and effect.
5. Personal Property
You are responsible for your own personal property at all times. Rabbit Hole Studios is not responsible or liable for any loss, theft, or damage to instruments, equipment, recordings, vehicles, or other belongings brought onto or stored on the premises, whether in a locker, studio, office, or common area. We recommend you carry your own insurance for valuable items.
6. Equipment & Space Rentals
Rented equipment and spaces remain the property of Rabbit Hole Studios. You agree to inspect rented items at pickup, use them with reasonable care, and return them on time and in the same condition, ordinary wear excepted. You are responsible for the full cost of repair or replacement of any item lost, stolen, or damaged while in your possession, and for any late-return fees. PA systems and sound equipment must be operated within their rated specifications by competent persons.
7. Code of Conduct & Substance Policy
Rabbit Hole Studios is a welcoming community space open to people of all backgrounds. You agree to treat staff, members, guests, and property with respect, and not to engage in harassment, discrimination, violence, theft, or any illegal activity. As a substance-free venue, we do not permit alcohol or illegal drugs on the premises. We reserve the right to refuse service to, remove, or terminate the membership of anyone who violates this code of conduct or these Terms, without refund.
8. Photography & Media Release
Our events and spaces may be photographed or recorded for documentation and promotional purposes. By attending an event or using the facilities, you consent to being included in such photos, video, or audio, and grant Rabbit Hole Studios a non-exclusive, royalty-free license to use that media. If you do not wish to be recorded, please notify staff in advance.
9. Intellectual Property
You retain ownership of the original creative work, recordings, and content you produce using our facilities. Rabbit Hole Studios retains all rights to its own name, logos, website content, and materials. Nothing in these Terms grants you any right to use our trademarks or content without prior written permission.
10. Disclaimer of Warranties & Limitation of Liability
The facilities, equipment, and services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by Georgia law, the total liability of the Released Parties for any claim arising out of these Terms or your use of our facilities or services shall not exceed the amount you paid to Rabbit Hole Studios for the specific booking or service giving rise to the claim, and the Released Parties shall not be liable for any indirect, incidental, consequential, or punitive damages.
11. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision, and your continued use of our facilities or services after a change constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in Clarke County, Georgia, and you consent to their jurisdiction.
